PROTECT ENTERPRISES AND CONSUMERS > Competitions with Prizes

The intervention of Chambers of Commerce in events carrying prizes is a novelty introduced by Presidential Decree 430/2001, which radically amended this matter by defining the Chambers officer taking part in the draw phase as a guarantor of public faith. Events carrying prizes are divided into "operations" and "competitions with prizes".
Operations with prizes consist of presents to those who sell or purchase a given product or service. In these cases, it is sufficient for the legal representative of the promoting company to draw up a statement containing the rules.

Competitions with prizes do not entail any obligation to purchase products or services, and the prize award depends either on fortune or on the competitor’s ability. Any intention to announce a competition must be notified to the Ministry of Productive Activities. Afterwards, a copy of the competition rules and the receipt of a deposit (of the same amount and value as the prizes at stake and paid to the Ministry) shall be sent to the Ministry of Productive Activities. Winners are designated in the presence or a notary or an officer of the Chamber of Commerce.
